Terms of Service

By using the services provided by Blue Sky Advantage, a division of HD-West Inc., you agree to the terms outlined in this document. Please review them carefully. For any questions, contact us at Admin@BlueSkyAdvantage.com.

Overview of Services

Blue Sky Advantage specializes in the design, installation, inspection, maintenance, and repair of water and wastewater systems, as well as general contracting and construction services. These services are provided in accordance with industry standards.

Refund and Cancellation Policy

Once services have been rendered, all payments are non-refundable. This includes any deposits or prepayments unless otherwise stated in writing or specified by law. Clients must provide written notice at least 24 hours prior to the scheduled service for cancellations to receive a full refund of any prepaid amount. Cancellations made with less than 24 hours’ notice will incur a cancellation fee equal to 50% of the prepaid amount. Cancellations after work has commenced will not be eligible for refunds. If a service is only partially completed, a pro rata refund may be issued, calculated based on the percentage of work completed and materials used.

Force Majeure

Blue Sky Advantage shall not be liable for any delays or failure to perform its obligations due to events beyond its reasonable control, including but not limited to:

• Natural disasters
• Acts of war, terrorism, or insurrection
• Strikes, lockouts, or labor disputes
• Fires, floods, explosions, or other acts of nature
• Government restrictions or public emergencies
• Other unforeseen events beyond Blue Sky Advantage’s control

In such events, Blue Sky Advantage will use reasonable efforts to notify clients promptly and reschedule services when feasible. Clients agree to cooperate in rescheduling affected services.

Limitation of Liability

To the fullest extent permitted by law, Blue Sky Advantage shall not be held liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of income, revenue, reputation, or business opportunities, even if Blue Sky Advantage was advised of the potential for such damages. The total liability of Blue Sky Advantage for any claim arising from its services will be limited to the total amount paid for the specific service giving rise to the claim and in no event will exceed the total amount of the client’s payment for the services performed.

No Guarantee of Results

Blue Sky Advantage does not guarantee specific results or outcomes from its services. All work is completed with professional care, following industry standards. No warranties or guarantees either express or implied are provided unless explicitly stated in writing. Services are provided on a best-effort basis and Blue Sky Advantage is not responsible for any failure to meet expectations unless due to the company’s gross negligence or breach of contract.

Service and Maintenance Work

If a system component is improperly installed, difficult to access, or inadequate, any additional damage incurred during repairs, maintenance, or servicing is the responsibility of the client. For example, if a pump is difficult to remove or access, any damage caused during removal or repair will be at the client’s expense. If a service requires modifications or accommodations due to the prior condition of the system, additional charges may apply, including charges for labor, materials, and equipment necessary to complete the work.

System Evaluations and Inspections

All system evaluations and inspections are limited to visible and accessible components only. Blue Sky Advantage does not perform or guarantee assessments of hidden, underground, or inaccessible components without prior excavation or removal. Evaluations are conducted using Blue Sky Advantage’s professional expertise based on the visible and accessible components at the time of inspection. Clients acknowledge that any parts of the system that are hidden or difficult to access cannot be fully evaluated without excavation, and Blue Sky Advantage cannot be held responsible for any unknown conditions not observable during the inspection.

Modifications to Terms

Blue Sky Advantage reserves the right to modify these Terms of Service at any time. The most current version will be posted on our website and will take effect immediately upon posting. By continuing to use our services, clients agree to the revised terms. It is the responsibility of the client to review the Terms periodically for updates.

Governing Law and Jurisdiction

These Terms of Service are governed by the laws of the Province of Alberta and the applicable federal laws of Canada. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Alberta, and the client hereby consents to the authority of those courts for the resolution of any legal matters.
